2.2 By creating the Account, the User declares that they have read, understood and accepted the Terms in full and that they have read the Privacy Policy.
2.3 A User who does not intend to accept the Terms must not register and must not use the Service.
Art. 3 — User requirements
3.1 The Service is reserved for natural persons who have reached the age of fourteen.
3.2 A User aged between 14 and 17 declares that they use the Service with the consent of the person exercising parental responsibility.
3.3 The Owner reserves the right to close, without notice, any Accounts found to be attributable to persons who do not meet the requirements set out in this article, deleting the related data.

4.1 In order to use the Service, it is necessary to create an Account, either by means of an email address and password or by means of authentication through a Google account.
4.2 The User undertakes to provide truthful information and to choose a nickname that is not offensive, misleading or liable to cause confusion with other persons, with third-party trademarks or with the Owner's staff. The Owner may request that it be changed or may change it directly.
4.3 Login credentials are personal and non-transferable. The User is responsible for keeping them safe and for any activity carried out through their Account, and is required to inform the Owner promptly of any unauthorised use.
4.4 Each User may hold only one Account. It is forbidden to assign, sell or transfer the Account to third parties.
Art. 5 — Description of the Service
5.1 The Service allows the User, by way of example, to:

- create, edit and share their Decks;
- play duels with other Users while keeping track of Life Points;
- make friends, send invites and receive notifications;
- customise their profile.
5.2 The Service is provided free of charge. The Owner reserves the right to introduce paid features in the future, subject to notice to Users and to an update of the Terms; no charge may be made without the User's express consent.
5.3 Duel Log is a personal tool for keeping and consulting your own records. It is not an official service, has no value for organised play or official tournaments, and does not replace, nor is it intended to replace, Konami's official applications and services, to which the User continues to refer for everything they provide for.
Art. 6 — User obligations and prohibitions
6.1 The User undertakes to use the Service in compliance with the law, these Terms and the rights of third parties.
6.2 The User is expressly prohibited from:
a) engaging in insulting, harassing, threatening or discriminatory conduct towards other Users;
b) entering or disseminating content that is unlawful, violent, sexually explicit or that incites hatred;
c) entering content that infringes intellectual property rights, image rights or other rights of third parties;
d) recording matches that were not actually played or altering results and statistics to the detriment of other Users;
e) sending unsolicited, promotional or bulk communications;
f) accessing or attempting to access other Users' data, circumventing security measures, impairing the operation of the Service or using it by means of automated systems (bots, scraping) without the Owner's written authorisation;
g) using the Service for commercial purposes without a written agreement with the Owner.
Art. 7 — User Content
7.1 The User retains ownership of the User Content.
7.2 The User grants the Owner a free, non-exclusive, worldwide licence to store, reproduce and display the User Content to the extent strictly necessary for the provision of the Service. The licence ends upon removal of the content or deletion of the Account, without prejudice to the provisions of Art. 8.
7.3 The User represents and warrants that they hold all necessary rights in the User Content and that it does not infringe the law or the rights of third parties.
Art. 8 — Sharing and retention of content
8.1 The User acknowledges and accepts that, owing to the characteristics of the Service:
a) anyone who has the link to a shared Deck can view it and save a copy of it; the copy saved by another User remains available to that User even in the event of subsequent deletion of the Deck or of the Account;
b) each recorded match retains a copy of the Deck used at the time of saving, which is not changed by subsequent modifications to, or by the deletion of, the Deck;
c) matches played with another User are also retained in that User's history, with an indication of the nickname used at the time of the match;
d) nickname, profile photo, background and frame, as well as the number of competitive matches played, the number of wins and the related percentage (Win Rate), are visible to other Users.
Art. 9 — Reports and moderation
9.1 Anyone may report content or conduct considered unlawful or contrary to the Terms by writing to info.duellog@gmail.com, indicating the content, its location and the reasons for the report. The Owner examines reports within a reasonable time and in a diligent and non-arbitrary manner.
9.2 In the event of a breach, the Owner may, depending on its seriousness: warn the User, remove or hide content, change the nickname, temporarily suspend the Account or close it. Decisions are taken with human intervention.
9.3 The Owner informs the User concerned of the reasons for the measure adopted, unless this is prohibited by law. The User may contest the decision within six months by writing to info.duellog@gmail.com; the Owner reviews the case and communicates the outcome.
Art. 10 — Intellectual property
10.1 The Application, the Duel Log name and logo, the interface, the graphic elements, the backgrounds, the frames, the texts and the software are owned by the Owner or its licensors and are protected by the laws on intellectual and industrial property.
10.2 The User is granted a personal, free, non-exclusive, non-transferable and revocable licence to use the Application in accordance with the Terms. Any reproduction, modification, distribution or decompilation not expressly authorised is prohibited.
Art. 11 — Third-party trademarks and content
11.1 Duel Log is an independent project and is not affiliated with, sponsored by, endorsed by or in any way connected to Konami. Yu-Gi-Oh!, and the names, texts and images of the cards, are trademarks and works of their respective owners, including Konami Digital Entertainment and Studio Dice / Shueisha, and are reproduced in the Application for the sole purpose of enabling the identification of the cards.
11.2 Card data and images are provided by third-party services, over which the Owner exercises no control.
11.3 Rights holders who believe that their rights have been infringed may write to info.duellog@gmail.com; the Owner will take action promptly.
Art. 12 — Third-party services
12.1 Certain features depend on services provided by third parties (by way of example: authentication through Google, card databases, device notification services). The use of such services is subject to the terms of the respective providers.
12.2 The Owner is not liable for the unavailability or malfunctioning of third-party services.
Art. 13 — Availability of and changes to the Service
13.1 The Service is provided "as is" and "as available". The Owner endeavours to ensure that it functions properly, without however guaranteeing its continuity, the absence of errors or its fitness for particular purposes.
13.2 The Owner may at any time modify, suspend or discontinue the Service, in whole or in part, including for maintenance or security reasons. In the event of permanent discontinuation, the Owner gives notice thereof in the Application at least thirty days in advance, except for causes not attributable to it.
13.3 Statistics, scores and calculations made available by the Application are for information purposes only and do not replace the official rules of the game or the decisions of judges at tournaments.
Art. 14 — Limitation of liability
14.1 The Owner is liable without limitation for damage arising from its own wilful misconduct or gross negligence and in any other case in which the law does not permit liability to be excluded or limited.
14.2 Outside the cases referred to in the preceding paragraph, and to the extent permitted by law, taking into account that the Service is free of charge, the Owner is not liable for:
a) indirect or unforeseeable damage;
b) loss of data, statistics or content;
c) interruptions, suspensions or malfunctioning of the Service;
d) conduct or content of other Users;
e) events depending on the User's device or connection or on third-party services.
14.3 In any event, the mandatory rights granted to a User who is a consumer under the applicable legislation remain unaffected.
Art. 15 — Indemnification
The User undertakes to indemnify and hold the Owner harmless from third-party claims, damage and expenses, including reasonable legal fees, arising from unlawful User Content or from breaches of the Terms attributable to the User by reason of wilful misconduct or negligence.
Art. 16 — Term, withdrawal and closure of the Account
16.1 The Terms are effective for an indefinite period from the creation of the Account.
16.2 The User may withdraw at any time, at no cost and without any obligation to give reasons, by deleting their Account from the Application's settings. The effects of deletion on the data are described in the Privacy Policy.
16.3 The Owner may suspend or close the Account in the event of a breach of the Terms, in the manner provided for in Art. 9.
16.4 The provisions which by their nature are intended to survive, including Articles 8, 10, 11, 14, 15 and 19, remain effective even after the termination of the relationship.
Art. 17 — Processing of personal data
The User's personal data are processed by the Owner in compliance with Regulation (EU) 2016/679 and as described in the Privacy Policy.
Art. 18 — Changes to the Terms
18.1 The Owner may amend the Terms on account of supervening regulatory, technical or security requirements or requirements connected with the evolution of the Service.
18.2 Changes affecting the User's rights are communicated in the Application at least fifteen days before they come into force. A User who does not intend to accept them may withdraw by deleting the Account within that period; continued use of the Service after that date entails acceptance of the new Terms.
Art. 19 — Governing law and jurisdiction
19.1 The Terms are governed by Italian law.
19.2 For any dispute with a User who qualifies as a consumer, the court of the User's place of residence or domicile has exclusive jurisdiction. The mandatory protections provided for by the law of the Member State of the European Union in which the User has their habitual residence remain unaffected.
Art. 20 — Final provisions
20.1 The invalidity or ineffectiveness of one or more clauses does not affect the validity of the remaining clauses.
20.2 The Owner's failure to exercise a right does not constitute a waiver of that right.
20.3 The Terms, together with the Privacy Policy, constitute the entire agreement between the User and the Owner in relation to the Service.
20.4 In the case of translations, the Italian-language version prevails.
Art. 21 — Contacts
Any communication relating to the Terms may be sent to info.duellog@gmail.com.
